What can I do if I am facing discrimination from my employer ?

During the hiring process and in the workplace, there is zero tolerance for discrimination. An employer cannot refuse to hire you, decide to fire you or discriminate its current/future employees.

Hence, age, gender, physical appearance, sexual orientation, disabilities, marital status, pregnancy, religion, political beliefs, being a member of a union/an association, where you live, where you chose to open a bank account, your ability to speak in another language besides French ... can not be taken into consideration by your current/future employer when he/she decides to hire someone, give a promotion ...

In order to prove that you are facing discrimination in the workplace, you will need to present factual elements leading to believe that your current or future employer's decision was based on a discriminatory consideration.

This means that you don't have to prove that there was discrimination but simply that there is reason to believe that you are a victim of discrimination given the circumstances of the employer's decision.

Your employer has the right to defend himself/herself by establishing that his/her decision was not based on a discriminatory consideration.

A juge will make a decision after listening to both parties and if necessary after ordering further investigations.

If for instance, it is proven that an employer fired you because you were pregnant, identified as LGBTQI+..., you may return to the office. It's as if you were never fired.

Frequently, employees don't want to go back to work in a toxic environment.

This is why, usually, employees simply ask their employer to pay them for the salary they lost if, for example, they got fired.
