Is surrogacy legal in France ?

In France, surrogacy is illegal.

It is worth noting that many couples go to foreign countries in order to be present for the birth of their child via surrogacy. When coming back to France, they find out that their children are not considered to be their own by french authorities.

It is important to keep in mind that if you are not the child's biological mother/father and your name is not mentioned in the child's birth certificate by the foreign authority, you may need to adopt your child in order to be considered as the child's legal parent if you decide to move back to France.

Depending on the case, some exceptions may apply.
